Which is sad because before I went through my ROTC program, about four years earlier, they would allow cadets to go through the certification process on their own time if they wanted to.<br />
<br />
Anyway it was not that bad, kind of fun. Although having a hard time imagining the scenarios that it would be used, but I suppose it is one of those things were you conduct training with the purpose of hopefully never having to use it in real life. Because at that point it could literally be a fight for your life.</div>

I dont want to be typical &quot;law nerd&quot; and start saying hey look at this cool new case that just came out. However, I figured this would interest (Piss off) a lot of posters here.  Basically the 9th Circut Court of Appeals has stated that the Stolen Valor Act which makes it a federal crime to  falsely claim to have received a medal from the U.S. military is unconstitutional since it violates the 1st amendment. The reasoning being that no one is really hurt by these lies, and since freedom of speech is a fundamnetal American Constitutional right, the Fedeal Government does not have compelling enough of a reason to ban this type of speech.<br />

Personally I think the decision is BS. While there is a fundamental right to free speech, there is no fundamental right to fradulent speech, especially if you are using that to gain some type of a material gain (Veterns benefits, prefrence for hiring, etc). I really hope the Solicitor Genearals office or someo other executive agencey appeals this to the Supreme Court. <br />

I would make comments about why I think that is unlikely to happen, but after seeing the whole Gen. McCrystal situation, I will refrain until hopefully Jan 23, 2013.</div>
